Legal Question in Landlord & Tenant Law in California

I've been renting a room in my condo and have told my renter to move out. I gave her @ 2 weeks notice. She was supose to be out by the end of May. Half of her belongings are still in my house. She will not answer her phone or return a voicemail or text message. How long do I have to wait before I can consider her belongings abandoned and dispose of them myself?

first of all, since she was a renter of yours, you had to give her 30 days written notice, so she could always claim the notice was defective. However, that only means that she would be able to stay longer and continue to pay you rent.

You imply but do not state that she no longer is physically there. You can not consider to have abandoned the items until it is clear that she has left and does not intend to return. At that point., give her 18 days written notice [send it to her last known address, her e-mail, etc., that you plan to hod an auction of the items with any appreciable value, advertise in Craigslist and similar other places, and then if no one buys at the auction you can give it to Goodwill, etc., buy it yourself giving her credit for a reasonable sum, or throw it out. Send her a letter before you toss the items as to what happened at the auction.lives
