Re: request/counter-request to set date for trial- unlawful detainer

In an eviction lawsuit, the plaintiff/landlord can request that the matter be set for trial by using the form that you received. If you take no action, the matter will be set for trial very shortly.

By filing a counter request, you can tell the court any dates when you are not available. If you have moved out, the landlord is not entitled to an early trial date and you may so inform the court.

The form is easy fill out, but you must have someone mail a copy of the completed form to the landlord's attorney, sign a proof of service and you must file the original form with the court.
