Legal Question in Landlord & Tenant Law in California

I have been doing research online about evictions because we received a note from our co-tenants stating we have until Nov. 1st to find another place to live. Our lease isn't up until June of 2010. The information I have found online states that they clearly cannot evict us. And their basis for the eviction has no grounds but they say that they have the landlord on their side for whatever reason. I have spoken with the landlord and he said he knows nothing about this. Also stipulations of the lease agreement prohibit pets without a pet deposit, they have not paid that and they have brought one into the home. Also there is a no smoking within the premises verbal agreement between all of us and the landlord and they have started doing so. What legal action can I take if any?

If you are leasing under them, they have a contract with you that they can terminate subject to the terms of the sub-lease. If you have a lease with the owner of the property, only the owner can evict you. Since it seems the later exists, you do not have to do anything except show your research to the tenants trying to evict you in order to tell them to stop bothering you. Get the landlord to confirm in writing that he has no intent to try to evict you, since the other tenant will continue to allege the opposite. You do not have to file any legal actions.
