Residential Lease Termination

I occupy a leased apartment in

Laguna Niguel, Califorina. I signed 30

day notice to vacate by 5/1/07. The

term of the lease is finished on that

date. I found out that my new

apartment will now be ready to move

in until 5/7/07. The apartment

manager says that they already

rented the apartment I currently live

in and will change the locks and

charge me for the removal of my

property if I don't vacate by 5/1/07.

Are they within their rights to make

me move if I don't have anywhere to

move yet?

They are within their "right" to do so, however perhaps you are looking at this from the wring direction. Did you sign a lease to move into the new place on 5/1? If so, you should work with the new landlord to arrange and perhaps pay for alternative arrangements. Sometimes a quick letter from a lawyer will help things along.
