Legal Question in Landlord & Tenant Law in California
i returned home this weekend from being gone for a few hours to find things missing in my apartment. all my windows were closed and locked, even my deadbolt was locked, which common sense points to the person that came in to my apt has a keyed entry. the tennants keys are not locked away in my managers apt, they actually all hang openly in the kitchen. she has a young teenage son, whom i believe did this. i no longer feel safe in the place ive lived for 3 and half years. i need to move out immediatly. they are trying to say i need 30 days notice, which is in my contract. but i feel like they have breached the contract on thier side and i think it would be fair for me to be out by the end of the month, which i have already paid for. i cannot afford to pay for two apartments at once, but knowing i cannot trust my managers family, i need to move out as soon as possible. i was wondering if they wouldnt oblige me in this special circumstance, would i be able to take them to small claims court? would it even be worth my time?
