Legal Question in Landlord & Tenant Law in California

Rights as a homeowner

We have a woman living in our house and she pays us a small amount of rent. She has a brother who is not welcome here. He doesn't abide by anything that we ask him to respect and because of that he has broken things that belong to us. Recently he was here and we again asked him not to touch or try to fix anything and he got mad. He was screaming obscenities at my family and I told him to leave. He wouldn't leave until I said I'd call the police. Do I have the right not to allow him in my house the next time he shows up?

There are two aspects to the question. If you have any type of limitation as to vistors in her lease you can enforce it. In general, you can ban a visitor who has damaged your property. You should send a letter to both of them explaining in detail everything he has done to make him unwellcome, including the incident where he swore at you and lost his temper. Then speak to the tenant and tell her why he is banned.
