what are my rights when kicking roommate out who is not on the lease? Roommate has been here for 3 months but has caused nothing but problems. Do I have to wait 30 days for them to leave?

If you have sub-leased to another person then your relationship to them is the same as the landlord's relationship to you. So if they have paid rent or promised to pay, you must give them a thirty day written notice and they have to leave on the thirty day starting from the day after they receive the notice. If they have violated a condition of the tenancy, such as not paying rent,committing a crime, damaging property, you can give them a three day notice to remedy the situation or leave.
