my rights as a landlord

I own a condo in another county (50

miles) and am having increasing

difficulties with my tenants.

They took over the lease 5 months

ago from my their roommate, my

previous tenant. They are currently

due for August 1st and did not pay

July until the 31st of that month,

they acknowledge they are late and

promise everything, no follow

through. Now I have serious

complaints from the other

homeowners in the association that

do live on premises, and it keeps

getting worse. I have had to drive

50 miles 3 months in a row to collect

the rent and now I am aware of two

additional people living there that I

do not have a lease agreement

with, despite numerous requests.

These guys are in their early 20's,

seem nice enough, and do have

good jobs, but are proving to be

totally irresponsible. I can't ''babysit''

for them anymore, I have my own

bills to pay and they are screwing

me up with the late/non payments

every month!

I've done my best to work with

these guys, but now I'm fed up and

just really wan't to terminate this

headache of a lease. What can I

do?

You can give them a three day notice for them to pay the rent or leave and probably a 30 day notice [might actually have to be 60 days] for breaching the lease. The two extra tenants may also be grounds to evict them, especially if the HOA rules limit the number of people in a unit. I would suggest yuou contact an attorney whose Office is in that area so that he/she can correctly handle the eviction.
