My Rights
I live in an apartment complex upstairs and on May 20 2008, a massive tree fell and knocked my whole patio down. They apartment manager assured me that I will be reimbursed for all of my belongings lost. On May 27 2008, I called to see about my reimbursment. The apartment manager along with the insurance company said that they will not cover anything lost. I then asked to have all of my belongings back that were on my patio. The manager said that they were already gone. I never got to see my belongings or have the say if I still wanted to keep any of it. The total of my property lost was about $1,040. Do I have a good reason to take the apartment owners to small claims court?

You should make your requests in writing and document the events and the ways in which you attempted to correct the situation. If needed you should take the apt owner to small claims court.

I would not ask again, but retain an attorney for the purposes of writing a strong demand letter. This seems to work more often than not.
If you aren't paid, then small claims court is next.
