Legal Question in Landlord & Tenant Law in California

robbery

I have a close friend who just moved into an apartment and the day after she moved in she had gone to work and returned home that night to find that all of her things were stolen out of the apartment. She went to her manager at the apartment and told them she was going to move because she felt unsafe. The manager told hedr that was fine but that she needed to pay the next months rent. Can they do that with the circumstances?

Re: robbery

Possibly. The notice requirement is probably 30 days. However, because of the circumstances she may be excused from performing.

Regardless, she would only be obligated for a pro-rated portion of the next month's rent. For example, she can give notice on June 2, 2005 to move out on July 2, 2005 and only have to pay the rent for the two days in July. If she really feels unsafe, she should move, but try to do it in a way that minimizes problems for herself in the future.
