Legal Question in Landlord & Tenant Law in California

Roomate moved out without paying

I am the sole person on a month to month rental agreement with my landlord for a 3 bedroom house. Whenever people move in to the rooms I have available, I have them sign a rental agreement between me and them (doesn't involve the landlord) so that I have protection if something happens. I had a room mate move out (who signed the agreement) without notice on 11/28, 2 days before rent was due. Would it be worth it to sue him for the last months rent that he didn't pay, plus utilities from last month? I had to cover his rent plus mine which cost me undue financial hardship.

Re: Roomate moved out without paying

It would probably be in small claims court and the filing fee is relatively small. You will have to serve him with the claim which might be difficult unless you know where he lives or works. The court will add to the judgment the cost of the filing fee and of service of process. Then you will have to collect.
