Legal Question in Landlord & Tenant Law in California

roomate skiping out on rent

I moved in with a friend who 3 months into the lease (year lease) stole my check book and wrote checks to her friends for about $300.00 when I tried to contact her she left and I have not seen or heard from her in 3 months. I heard from my landlord today and they have not recived this months rent. What are my right and can I force her to pay for the rent?

Re: roomate skiping out on rent

Your friend's a thief and a flake. If you are not on the lease you are not responsible for the rent by contract. However, by staying in the apt., you will be required to pay the rent because you are ''enriched'' by living there. There's no such thing as free rent. If you can't afford to pay the rent, you can't force your so-called friend to pay it. The LL will have to deal with her for breach of lease. In the meantime, the LL will seek to evict you if you don't pay the rent. You should find another place to stay. Good luck.
