Legal Question in Landlord & Tenant Law in California
Hi, I have a roommate as of 1/611 who has taken over my home. She filled my garage with junk, a loaded refrig, threw patio furniture in the patio, lined the house with all her belongings, using my fridg when she has her own w/o my knowledge or permission. She yells at me, is so rude, takes over, is entitled, conrolling, acting like this is her home. So, I gave her a 30 day evicition notice on 1/26/ll. She has made no attempt to start parking & making arrangements to move. She told me tonight that she has no intention of moving but if I really wanted her to that I could pay her $2,000.00. What am I to do? Call the police? I have had renters in the past, never had any problems. I am totally dumfounded. My son is so mad that he wants to tell her off & move her stuff somewhere? I don't endorse this but something has to be done. I can't talk to her as she yells. I think that she defilitly has mental problems. HELP I only want to ask freely & get a free answer!

If you only have one lodger, her rights are far more limited than if you have more than one. You do not have to go through an unlawful detainer. When the 30-days are up, she becomes a treaspasser and you can have her removed by the police with no further notice.
