Legal Question in Landlord & Tenant Law in California

getting only one roommate out

i own the house, i live there, one is

fine, the other i would like to leave at

the end of their lease terms (6

monther which turns into month to

month) do i give notice at the

beginning of the 6th month to leave

by the end of the sixth month? Does

it mean anything that it goes into a

month by month, does that affect

my notice responsibilities, like do i

have to wait until the fixed is up and

then give notice for termination of

month by month? Also some of

these forms ask to list the other

roommates as if i would be required

to kick the other one out as well if i

dont give reason to this roommate

why he has to leave? I didnt want to

give reason as i thought it might

cause more conflict...but do i in order

to only remove the one roommate?

Re: getting only one roommate out

Private lodgers are generally treated differently than other tenants, but only where there are no other private lodgers.

You give give 30 days notice, at the beginning of the sixth month.

I don't know what form you are looking at, but a normal 30 day notice is all that is needed.

Just give notice to the one you want to leave.
