Legal Question in Landlord & Tenant Law in California

My Roommate

I took in a roommate about 6 months ago. I wrote up a contract with rules for one year. He's broken practically every rule that was on the contract. I've given him a 31 day varbal and written notice to leave cause of all the rules that he's broken. Is this legal? I don't know if I'll have trouble with him moving out yet but if I do, what do I need to do?

If you properly served the notice, his tenancy will be terminated. If he doesn't move out by the date stated in the notice, you may have to file an unlawful detainer complaint. Depending on whether or not he answers your complaint, you will either get a default judgment for possession of the premises or a court trial.

You might want to consider hiring an attorney. Doing it wrong can cost you time and money. Good luck.
