Legal Question in Landlord & Tenant Law in California

Rumbling Video Game Noise!

I have a common wall in my bedroom with a neighbor where rumbliing & thumping comes through the wall all evening & as late as 11-12pm from video games.I've told office several times & they have as much as called me a lier & have said to me ''we can't stop them from living''.Office says they contacted them & they denied it.Office said they could only put noise notices on all apts because the neighbor says they are being harrassed.Notices were NOT sent out.I had security & 2 neutral persons in to listen & everyone agrees it's coming from the wall.I told office I''ve moved my bed, slept in livingroom.I get up @ 4am & need my sleep. What recourse do I have?

Re: Rumbling Video Game Noise!

Most areas of California have some type of noise ordinance. Look yours up at city hall, county, seat, etc. They usually forbid such noise after 10 P.m.

You are entitled to the "quiet" enjoyment of your rental premises. You probably can break your lease and move, or sue landlord for damages.

It would be best to retain an attorney to write a letter demanding noise being stopped (written to landlord). You can do it yourself---certified---keep a copy, but attorney's letters frequently work better.

You can withhold rent (not always preferable).

Good luck! Let me know if you need more.
