Security Deposit

The previous owner sold the property,but the new owner say's we can't get our deposit back. It is a property with two houses on it, are we both out of our deposits? mine was $1000.00 and the other tenants $1100.00.

Absolutely, positively "B.S."

The California Code specifically says deposits go with the property when sold. The new owner MUST be responsible for the deposits.

There are three reasons to deduct from a deposit: (1) unpaid rent; (2) damages caused by tenant beyond ordinary wear and tear; (3) and cleaning, but only if the property is left dirtier than when tenant moved in.

What you don't say is whether you, or the other tenant, are ready to leave, since the deposit remains until the end of your residency on the premises.
