Legal Question in Landlord & Tenant Law in California

Security Deposit.

My roommates forced me and my other roommate to break the lease on the apartment we were sharing. We were told that we would get our security deposit back. We haven't it has been over 21 days. Nothing. WE keep calling and he says he is sending it but doesn't. We thought we reached an agreement he knows the circumstances and everything but it is like he is avoiding us. I just want most of my money back it is $2700 dollars.

Re: Security Deposit.

You don't give enough facts to answer this. How was the lease broken? What did roommates do to force you out? Were you on the lease (signed)? Who has the deposit (I assume landlord, but it could be another roomate). That is a very high deposit, and you are entitled to a refund of deposit within three weeks, except for unpaid rent and damages (caused by you) .Sounds like your best bet now is in small claims court, but I would need more facts.
