Legal Question in Landlord & Tenant Law in California

no security depost yet

I moved out of my apartment on may 29 2009. The original date i was supposed to move was a month before that but i requested an extension and they approved it. I left the day before my extension was up and left in the middle of the night, leaving keys inside apartment. The landord says that since i never turned in keys i was still considered living there and am gonna charge me for about a week and a half extra. Is this really the law. Also it is now the 27th of june and have recieved nothing in the mail from them.. What options do i have?

Re: no security depost yet

Did you tell the landlord that you moved out? Leaving the keys in the apartment isn't really a "surrender" of the premises, especially if you didn't tell the landlord that's what you did. I think it could go either way in court. Failing to surrender the keys combined with a lack of notice to the landlord is probably going to run against you. If the landlord actually took five minutes and looked in the windows of the unit to see that you were gone on the day you were supposed to leave will probably help your case.
