Legal Question in Landlord & Tenant Law in California
I'm separating from my husband at the end of the month January 31,2015. I gave a 30 day vacating notice to our property management but my husband will not vacate and just wants to be evicted from the house. We are on a month to month basis and did not renew our lease last year. The property management says that even though I gave a proper 30 day notice and he continues to stay and not pay rent that I'm still liable because I signed the lease in 2013. My question is why do I have to be included on the eviction when I gave a 30 day notice? I can not afford to have an eviction on my credit. Thank you.

You're on the lease. That is a contract you signed. Until the premises are turned over to the owner, you are liable. You should have filed for divorce or legal separation first and obtained an order that your husband move out or enter into a new lease.
