what to do is served a 3 day pay or quit notice. do i need to respond to it?

You have three choices, pay what you owe, move, or wait for them to serve you with a summons and complaint for unlawful detainer.

Either pay them, move out or prepare to get sued. If you have some disagreement about the amount of money owed, conditions allegedly violated, or about the condition of the property such as habitability issues you need to raise those in the lawsuit as a defense. The 3 day notice is a requirement for your landlord before they can sue to evict you.
