Legal Question in Landlord & Tenant Law in California

Serving a Resident Manager--3 day or 30 day notice?

How can I serve a resident manager to begin eviction? Is is a 3 day notice or a 30 day notice? The resident manager has resided less than a year and their rent was subtracted from the last paycheck. However, they are still residing in the apartment. I didn't have them sign a lease agreement and the employee agreement isn't a contract and doesn't state a specified time that they have to vacate. What are the options? Thank you.

You would proceed as if it were a regular eviction, but on a 30 day notice. If the RM has not paid rent, then proceed on a 3-day notice. However, the 3-day notice has a cure provision. If you want the RM out, serve the 30 day. Good luck.
