Legal Question in Landlord & Tenant Law in California

Already have a settlement

We signed a Settlement Agreement that was also signed by the judge to pay off past issues with our Landlord. Afterwards they claimed that the Property Management Co. can add additional rent and bogus damage costs already covered by the settlement and are demanding payment. When written to, the Judge refused to act. Can I compel the Settlement to be honored by the management company or change the venue or compel the judge? He's not friendly to Tenents.

Re: Already have a settlement

If you have a settlement agreement, both parties must abide by it.

I would need more about the judge refusing to act. It may well have been that you were seeking an ex parte action (appearance before the judge without other side being present) and that would be unethical for the judge to hear this.

You cannot change venue, and you really do not want to try to compel the judge to do anything. Since your zip code is in Santa Clarita, I am sure you can find a local attorney who is familiar with your Superior Court judges and get some help.

You can also go to the State Bar's lawyer referral service, and get some help at a reasonable fee.

Good luck!
