Legal Question in Landlord & Tenant Law in California

sheriff served tenant 5 day notice

my tenant was served a 5 day notice to move by the sheriff on Thursday Feb5th(2005). When does the 5 days start so I can figure when he needs to get out? Does he have to give me the keys or can I just go in? If he does not move, do I have to call the sheriff so they can lock him out?

Re: sheriff served tenant 5 day notice

The 5 days starts from the date that the Sheriff serves the 5 day notice. You will not learn about the lock out date until the last minute - maybe even the morning or the day before the lockout if you are unlucky. You should meet a locksmith at the property at the date and time of the lockout to change the lock. Please contact me or my office if you have any other questions on this or collection for your money judgment.
