Legal Question in Landlord & Tenant Law in California

Sheriff's Notice

I received a notice on my patio stating that I lost my eviction case by default and that I must vacate by the 12/13/07. I was never served with an unlawful detainer. What forms do I need to fill out so that I can go before the judge and let him know what happened. Am I doomed, this just doesn't seem right that they can evict me without giving me a chance to respond. --name removed--note that I am all paid up on all rent, but I am a mth to mth tenant.

Re: Sheriff's Notice

You should file a motion to vacate default and default judgment with the court. You need to ask for a hearing date before the lockout date.
