Legal Question in Landlord & Tenant Law in California

If i sign a 1 year lease on a single dwelling in san jose ca. And after 3 months i discover it was never legal to lease because of permits and plans dateing back 100 years. Has the property manager broaken the law

He has broken the law but I would keep paying rent because if you stop paying rent, he can still evict you.

I would agree that you should not stop paying the rent, but you should contact the building inspector's department to determine the actual status of the property. I would try to negotiate a move out agreement, if the conditions are unsafe that allows you to move and have your security deposit, at a minimum refunded as well as a neutral reference to any new landlord.
