The check does not become a contract. That being said, however, you can have an oral lease agreement (by agreeing with the manager that you will pay "X" dollars per month for rent, and their delivering possession of the property to you). The terms of an oral lease like that are very very vague, but generally if there is no agreement, you default to a month-to-month lease under the Civil Code.
