Legal Question in Landlord & Tenant Law in California
co signer on month to month rental lease
If i can't get my aunt to give a thirty day notice so i can get off the lease, is there any legal action i can take against my aunt to make her get out, cause if i have to end up paying the rent so that my credit doesn't get ruined i would want them to get out.

You can sue her in Small Claims court, but, if she is broke, it won't due you much good.
See if you can work out something with the landlord. Probably the best you can do is negotiate paying for your aunt to be evicted, and you pay the costs. Landlord must evict, you cannot, and court costs can be in the area of $500-$600, unless landlord retains attorney, and then you are looking at another $400 or $500 minimum.
Good luck!
