Legal Question in Landlord & Tenant Law in California

If the lanlord does not give you copy of your lease and refuses to give you a copy when you have asked on many occasions. Habitability is poor as far as roaches, and no heater. She decided to hire a gardner and charge us and we were not notified nor did we sign anything. All tenants are military and need to vacate the premises by May 1st and the landlord refuses to let us. She told us that we were to pay a first and last months rent and first months rent and the last month could be used for the last months rent which would be april 1st and she argues that we never had that conversation. Again how are we supposed to know what needs to be done if we have no lease to go by? In need of serious help. She has also done this to 3 other tenants.

You are correct in your statement.

You are entitled to a copy of the lease, no roaches, a heater, etc. You should not pay for the gardner, unless a provision exists in lease to the contrary.

If you are all military, and knew of the May 1 deadline, your lease should end on May 1.

You should either send her a certified letter, delineating the problems, or retain an attorney for the express purpose of writing a strong demand letter.
