Legal Question in Landlord & Tenant Law in California

Space rent increase

I have lived in a mobile home for almost 2 years and began paying a space rent of $525. It has been raised twice and is now $625 (the latest raise being February). We are currently trying to sell at what we owe to get out since we will be moving across the country next month. During this time, the park mgmt has advised that the space rent for the buyer will be $850. We have had several interested parties until they hear of the absurd space rent. This is impeding our ability to sell and we cannot afford to pay for a new place and this place at the same time. Is there anything that can be done about this? They do allow many of the park rules to be broken by other residents and I have this documented. They also do not keep the park nice enough to necessitate these increases. Can I use that to get some kind of agreement since the rule breaking has continued to affect my family's right to a certain quality of life?

Re: Space rent increase

Unless you live in an area under rent control, and by your zip code, you do not, the landlord may raise the rent.

You are faced with a difficult situation, even if you can prove discrimination against you by the landlord.

Of course you can try to negotiate, but it is unlikely you will get management to budge. It would be a help, if you could prove that no one else is paying $850 a monrh.

If you can't negotiate, you may need to hire an attorney, but, basically, unless you can show that you are being singled out for some reason, the park management can raise the rent.

There are also some specific statutes regulating mobile home parks. I don't have time to do research right now, but I would recommend going to the law library and looking this up. You can also go to findlaw.com and look up the statutes regulating mobile home parks.
