Legal Question in Landlord & Tenant Law in California

Squatter's Rights in an apartment unit

In a small apartment complex, 20

units, there are squatters in one of

the units who have apparently been

there some time. They have no

lease, but get their mail, utilities and

all else in their names....for the

majority of the time they've been

there, about 18 months, they pay

rent, always in cash....what are my

problems in getting them out?

Re: Squatter's Rights in an apartment unit

It depends whether you're a manager or another tenant. If a tenant, you have no rights unless they're creating a nuisance that impacts your quality of life.

If you're the manager, follow the appropriate legal steps to evict them. Get a lawyer to handle it for you and save a lot of grief.

Mr. Cohen's answer is thorough, and as Mr. Shers points out, they are probably not squatters.
