if someone is staying as a guest and doesnt pay rent and refuses to leave what steps do i take

Since they are not paying rent they are not a tenant and the landlord/tenant laws do not apply. If the person goes out of your house for several hours, change the locks, pack their things into boxes and put them outside but not where someone is likely to steal them or they will get rain damaged. Notify the police first so if he/she calls them they will know what the situation is about [perhaps].
Offer the person a bribe with the amount of money you will give them going down each day. You can call the police but they may refuse to get involved. Find out why they will not leave and see if you can do anything to solve that problem.
