Legal Question in Landlord & Tenant Law in California

Subleting

My roomate has moved her boyfriend in and he is not on our lease. I have talked to the management and they basically told me they can't do anything, because they have no proof. They acted like they didn't want to get involved even though it is in violation of the lease. Can they do that? Shouldn't they have to do something?

Re: Subleting

E-mail or post the pertinent lease terms. If your roommate is in violation of the lease, and if both you and your roommate are signers, you can enforce the lease. As far as getting the landlord to do something, you may be able to use a breach of contract claim to motivate them. But as they have stated, they have no proof. You may want to start keeping a log of every time your roommate's boyfriend stays overnight.
