Legal Question in Landlord & Tenant Law in California
can you sue for discrimination if you can prove you were evicted from your home because of affiliation with a family member of the landlord who took their parent, our landlord to court? They evicted on the basis that we did not pay rent but we have proof that we did. Now they wont return our security deposit either.
p.s. we also cooperated and talked to a city code enforcement officer, which is an other reason we believe we may have been evicted.

No but it could be a defense to an eviction as a retaliation for something you did like call the building inspector. You could raise that as a defense along with proving you did pay if you have not gone to court yet. If you have then as a separate lawsuit it would seem like a very good one. If your former LL doesn't return your security deposit or give you an itemized breakdown of why they won't i.e. that they spent in on fixing or cleaning your place you can take them to court and that would be the best lawsuit you have.
