Legal Question in Landlord & Tenant Law in California

How to sue my landlord? Nobody has an answer for me.

From Ca. I was served a 30 day Notice on both residential & commercial lease. Been at both for over 10 years. Landlord served us because we complained about the construction not being done as per lease agreement, resulting in a huge loss of income. UD and UD Answer served. How do I sue my landlord? Where do I sue my landlord? My counter suit would be for loss of revenue $185k. Thanks so much.

The time to file a cross-complaint would have been when you filed your answer. Now you'll need to file a motion with the court for permission file a cross-complaint. However, you MIGHT be able to raise a reliation defense to the eviction, but you had better hire an attorney right away if you don't have one.

You also have the right to file a separate civil suit for the damages you are claiming. Again, you should retain legal counsel to review the evidence to determine if you actually have a viable claim.
