Legal Question in Landlord & Tenant Law in California

Suing for Security Deposit plus Damages

I paid a $500 security deposit, but was never able to move into the residence. After 4 months, it has now reached the point where I have to file in small claims to recover my money. I want to know if I can ask for expenses/fees incured in attempting to recover my money, as well as statutory damages. If so, how much can I ask for?

Re: Suing for Security Deposit plus Damages

As Ms. Wertenberger aptly points out, the question cannot be answered, without more facts.

Landlord is entitled to keep whatever unpaid rent is from the deposit, itself. The rest of the answer is similarly vague at this time.

I agree. Please resubmit, and we wll try to help you.
