Legal Question in Landlord & Tenant Law in California
Summons Extention in CA
I would like to know how to get an extension for a summons (with no court date) that was sent to me twice with two different dates, by my old apartment complex, Villa Venetia Apartments. I did some research online and found out that the name they used on the summons is an expired fictitious business name.
Any advice would be greatly appreciated. Thank you!
Melissa

Re: Summons Extention in CA
Proper service consists of 1) personally serving you, or 2) leaving it with anyone over 18 who appears to be residing at your residence, or with someone in charge of your office, and then mailing it to you.
You might specially move to quash service (that usually only delays the inevitable proper service), demur to the complaint because the plaintiff lacks standing, or answer the complaint. If each of the summonses has a different case number, you might check with the court -- either online or by phone -- to see if the earlier one is still an open case.
Of course, it's always best to have an attorney handle it for you (a shameless plug).
