Legal Question in Landlord & Tenant Law in California
I had a surgery back in Jan. go very very wrong and the surgeon cut my liver and pancreas, etc... and I haven't been able to work for ten months. I'm finally able to work now. I had always been ahead on my rent on this house in CA. I'm now five months behind but have been trying to make payments and have made two it;s $3800 mo. I also paid $12,000 to move in. The landlord is now telling me he's going to evict me. How long do I usually have before I have to totally move out of the house? Is there anything I can do? I have another month i can pay him but should i keep paying if he's going to evict me or save it to move? I just don't know what to do??? please help!!!!

Since you are in grave financial trouble why are you renting a house for $3,800? You need to move to a less expensive residence. If you are not paying the rent there is nothing you can legitimately do to prevent the eviction as opposed to delaying it. From the date you are given the three day notice until when he can execute on it could be three months. You certainly have at least one month. Since you are still living there, I think you should continue paying rent, as you are three months behind with the security deposit covering two of those months. Try to make a deal with the landlord that you will move out by a certain date and make a payment in an agreed to amount.
