My tenant in California is month to month and every 2 weeks says he is moving out but doesn't leave and he keeps paying rent. When he finally leaves, it that considered giving me 30 days notice? It is August and he's been telling me he's leaving since March.

The tenant must give 30 days written notice, which apparently he has never done. None of the past vacating statements counts.

Sounds like you need to give him a 30 day notice yourself, and then give him the option of signing a lease for a specified term.
