Legal Question in Landlord & Tenant Law in California
Tenant guest
Myself and two others leased a 3 bedroom condo, splitting the rent and utilities 3 ways. One of the roommates girlfriends is always there, whether he is or not, she uses everything in the house, her belongings are there, she does not clean and above all pays nothing. In the beginning it was fine, but now its become an inconvenience to me. I have tried approaching him about it but he refuses to admit she lives there and goes above and beyond to make me miserable.
I am getting married 3 months before our lease is up and will be moving out. Is there any way I can get my portion of the lease covered by her or him because of her living there? What is needed to prove residence? What are the laws regarding guests? Basically is there anyway I can get out of the last 3 months of this lease without paying anything?
Thanks in advance.

Re: Tenant guest
You have a big problem. If all three of you signed the lease, then the landlord is entitled to collect rent from all three [did you sign that each was responsible for all the rent or each 1/3rd?] and your argument with the girlfriend is irrelevant. Did you have any agreement as to guests? You are likely stuck. Sorry.

I agree with Mr. Shers.
You have a remote possibility suing the boyfriend, but I doubt you would prevail. At least, the action would be in Small Claims Court, where you don't have legal fees to pay.
