Landlord violated ''warranty of habitability''. He wont file unlawful detainer, he fears going to court. How do I start the process myself. I need a day in court for my pain and suffering.

Go to small claims for forms, or look on the internet.

It is best to send him a certified letter first, or have an attorney write a strong demand letter.

You also should have some medical bills, and have missed work. You haven't given me any facts here.
