Legal Question in Landlord & Tenant Law in California
I have a tenant, who wants to move from downstairs to an upstairs apartment within the same complex. There is no problems in the apartment Tenant resides in presently, he just wants to move upstairs. Is it illegal for the Landlord to refuse Tenant to move to a different apartment?

No. But an upstairs unit is more desirable than a downstairs, so presumably worth more rent. So why would a landlord NOT take the opportunity to enter into a new lease at a higher rent?
