If I my tenant gives me rent checks for less than the lease amount ( 4 months in a row) and I deposit them, am I concidered to have agreed to the new amount

No. Just send the tenant a three-day notice for the balance for each of the four months, i.e. to pay or quit.

No. Your recourse at this point is to send a three day notice to pay or quit. If you do not wish to do this, at least document that you are not accepting the change in rent by providing the tenant with written correspondence, return receipt requested.
