I am a tenant in a house that recently flooded due to roots growing into the piping. We had no toilet for one week and there was mold growing everywhere for 2 weeks before i got the authorization to stay in a hotel. She agreed to pay after we paid our share of the rent for the hotel. Once it exceeded that she did not want to pay. I have no spleen and have had numerous surgeries and was feeling sick in the mold. My roommate has a baby who also experienced the mold. Eventually insurance paid to fix the place up. 3 days later the toilet broke again. During the flood my lap top got ruined and so did some clothes. She does not respond to my phone calls or letters. Also pg&e came and gave us a notice that the water heater was dangerous and needed to be replaced. Showers get cold very quick. She has not paid for that either. Her son acted as her representation. He showed us the property, met with us to sign the lease, is the one that handled the insurance claim, and is the one who was always present when something went wrong. He told us that his mother would take care of everything. I even spoke and discussed the issue with her one time and sent her a letter. She ignores us. Can I sue her for physical, financial, and emotional damages?
