Legal Question in Landlord & Tenant Law in California

The right of one tenants when living with other tenants

I movied into a three bedroom house with my son, daughter-in-law, five grandkids, and my dog. Since I had sold my house so was asked if I would pay for the first months rent and deposit. This came to a total of $3987.50. I also had paid for the rent on thier old place of $800.00 and paid back $300.00 they had barrowed from some one else. There was also some other money barrowed as well and I was told they would pay me back for this of which I wasn't worried since we are family. But once my money was gone and my job slowed down, so my money was very tight, everything changed. I still paid my rent but a few times I was short. Our rent is $1595.00 per month of which they had asked me to pay $750.00 then after the new year lowered it to $650.00. My daughter-in-law and I have not gotten alone since my money ran. Now she is tring to kick me out but since we three signed the lease, she really can't so now she has decided that I don't deserve any of my money back. Can I apply to small claim court now befor our lease is up or do I have to wait until then because with out the money I can not move and I can't aford the place on my owe. The total amout that they owe comes to $5150.00. What is your suggestion. I need help. Thank You

My first suggestion is don't bother suing family. If they stiff you for money, it's a lesson well learned.

The next thing to do would be to try to negotiate yourself out of the lease, with a full release of liability, and get a new place, just you and your dog. Good luck.
