Legal Question in Landlord & Tenant Law in California

I have a tenent that is getting drunk and smoking marijuana, he never disclosed the fact that he has a medical maijuana card (which he now cliams to have). I also have a 5 year old daughter in the house 3 days a week..He also did not pay rent on July first. I gave him a handwritten 30 day notice on July 5th that my other roomate witnessed. Is that good enough to serve as a 30 day notice or do I need a printed one from a California site. He is also violent. What is my best way to go. if I need to evict him. he is also A Vet and recieves VA checks too.

Thank you

Jeff

Has the tenant lived in the property for a year or more? If so, you need to give him a sixty day notice. Assuming he has lived there less-than one year, then a hand-written notice can be acceptable if it contained all of the correct language. You do not have to give any reason, assuming he is a month-to-month tenant, for terminating his tenancy. Just be sure to have someone review the notice to be sure it contains the correct language before filing suit.
