Legal Question in Landlord & Tenant Law in California

tenet did not pay rent.

I have a friend whose mother in law rented a room out to someone.

Don't know his name and there is not contract or anything. He did not pay his rent this month can she tell him that he has to move out if he does not pay.

You are unclear as to whether there was a room rented in her house, or in a building she owned.

If the tenant was the only tenant, he is called a private lodger, and she can have the police evict him, as long as she gives proper notice.

In regard to a tenant, California law requires that either/or a three day or 30 day notice be given and certain legal procedures followed. The law is very pro-tenant so if she anticipates having similar problems in the future, it might be well worth it for her to hire an eviction service or attorney to see how it is done. She should also read the various comments that have been posted for a long time on this site. But she has to do it herself, not you. You might give her excellent advice and instructions, but she may chicken out or fail to follow what you said. People normally value the advice they receive by the amount of money it costs them.
