Terminating tenancy
What are my rights as a landlord to terminate tenancy.This person and I had a month to month verbal agreement.It is decided to terminate tenancy.This individual gave me 30 day written notice to terminate tenancy and vacate premisses--name removed--ever 30 days are up they are not leaving.I have another tenant waiting to move in.How do I legally get this person to vacate?I would like to stay out of court if at all possible.

If you want to stay out of court, your best bet is to pay them to move. This is common in San Francisco where landlords usually cannot get tenants to move because of rent control.
The tenant's 30 day notice is valid to terminate the tenancy. When it expires, you can go to court to evict him.

You can give the tenant a 3-day notice to move, based upon his termination of the tenancy. If he does not move, you will need to file an unlawful detainer (eviction) in court. There is no other way to "make" him move.
