Tilted Floor - Can I terminate Lease?

For a friend ( Foster City ). He's entering 4th month of 11 month lease.

After moving in & getting feel for the place, he sensed foor(s) not level. Don't know how much, only that he can feel it & placing a bowl on the floor causes it to move several inches . Tenant does not want repair or change of unit. His family ( 2 sm infants too) wants out.

Standard lease has no early term clause & usual ''resident has inspected..condition & accepts as is..''

Thoughts? Latent defect? Should he get housing inspector to

verify unaccepatble living condition?

This doesn't sound like much of a defect to me. Is it hazardous? I doubt that. A property doesn't have to be perfect to be rentable. It just has to meet minimum standards of habitability. I don't think your friend has much of a case.
