Legal Question in Landlord & Tenant Law in California

No toliets!!!

We have had a problem with our toliets and showers drianing. I called the property management Monday 1 pm and here it is Wednesday and we still have no use of our toliets and shower, sinks, etc... How long can they expect us to not shower or go to the bathroom.

Re: No toliets!!!

You should be able to withhold or deduct rent until repairs are done. What does your lease say about repairs?

Re: No toliets!!!

Generally, for "necessities" such as toilets, shower, gas leaks, etc. a tenant is required to first demand the landlord repair the problem, preferably in writing, and, if a "reasonable amount of time" (here, perhaps 2 days) has passed, the tenant may effectuate the repairs themselves and deduct that amount from their rental amount.

Please note that not all rental agreements have a provision regarding repairs, but most do. Take a look at the agreement and see what it says, it is probably pretty close to the above.

If you need a plumber in the greater Los Angeles area, I recommend Whyte Plumbing, Inc. They are online at www.WhytePlumbing.com.
